1. About These Terms

These Terms and Conditions govern your use of the Studio GBM website and the purchase of any products or services from us. Please read them carefully before placing an order. By using our website or placing an order, you agree to be bound by these Terms.

Studio GBM is the trading name of General Business Machines (Limerick) Limited, a private company limited by shares, registered in Ireland under company number 24992, with its registered office at Hartstonge Street, Limerick, Ireland. In these Terms, “we”, “us” and “our” refer to Studio GBM, and “you” refers to the customer.

2. Definitions

  • “Goods” means any products offered for sale on our website or supplied by us.
  • “Services” means any design, print, exhibition, installation or related services we provide.
  • “Consumer” means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
  • “Business customer” means any customer who is not a Consumer.
  • “Order” means your request to purchase Goods or Services from us.

3. Orders and Contract Formation

When you place an Order, you are making an offer to purchase Goods or Services subject to these Terms. A binding contract is formed only when we confirm acceptance of your Order, for example by issuing an order confirmation or by beginning the work.

We reserve the right to decline or cancel any Order, for example where Goods are unavailable, where there has been a pricing or description error, or where we are unable to obtain payment.

4. Products, Descriptions and Custom Work

We take care to describe and display our Goods and Services accurately. However, minor variations may occur, particularly in printed and manufactured items, where slight differences in colour, finish or material may arise as part of normal production. Where colour accuracy is critical, we recommend requesting a proof or sample before production.

Much of our work is customised, made to order or personalised. Please check all artwork, proofs, specifications and quantities carefully before approving production, as custom items are produced to your specification and, except where they are faulty or not as described, cannot be cancelled, returned or refunded once production has begun. This does not affect your statutory rights.

5. Pricing and Payment

All prices are quoted in euro (€) and, where applicable, are inclusive or exclusive of VAT as indicated at the point of sale.

We accept payment through our secure payment providers, Stripe and Klarna. Payment terms for bespoke projects, quotations and account customers may differ and will be set out in the relevant quotation or agreement.

We reserve the right to correct any pricing errors. Where a pricing error is identified after an Order is placed, we will contact you before proceeding.

6. Delivery

We will agree delivery timescales with you at the point of sale or in your quotation. While we make every effort to meet agreed timescales, delivery dates are estimates and are not guaranteed unless expressly agreed in writing.

Risk in the Goods passes to you on delivery. Please refer to our Returns Policy for details on delivery shortages, which must be reported within the timeframe set out in that policy.

7. Returns, Cancellations and Consumer Rights

Your rights to return Goods and to cancel Orders are set out in full in our Returns Policy, which forms part of these Terms.

If you are a Consumer purchasing online, you have a statutory right to cancel within 14 days of receiving your Goods under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, subject to the exceptions set out in the Returns Policy, including the exception for customised, made to order and personalised Goods.

Nothing in these Terms affects your statutory rights as a Consumer under Irish and EU consumer protection law, including the Consumer Rights Act 2022.

8. Intellectual Property

All content on our website, including text, images, graphics, logos and designs, is owned by or licensed to Studio GBM and is protected by intellectual property law. You may not reproduce, distribute or use any of this content without our prior written permission.

Where we create bespoke design or artwork for you, ownership and usage rights will be as agreed in the relevant quotation or contract. Where you supply artwork or content to us, you confirm that you have the right to use it and to authorise us to reproduce it.

9. Your Responsibilities

You agree to provide accurate information when placing an Order, to check and approve proofs and specifications before production, and to ensure that any materials you supply to us do not infringe the rights of any third party or breach any law.

10. Limitation of Liability

We provide our Goods and Services with reasonable care and skill.

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for any statutory rights that cannot be excluded.

Subject to the above, and to the fullest extent permitted by law, we will not be liable for indirect or consequential loss, or for loss of profit, business or opportunity. For Business customers, our total liability arising from any Order shall not exceed the price paid for the Goods or Services in question. This clause does not affect the statutory rights of Consumers.

11. Website Use

Our website is provided for general information and for the sale of our Goods and Services. We make no warranty that the website will be uninterrupted or error-free, and we may suspend, withdraw or change all or part of it without notice.

Any external links are provided for convenience, and we are not responsible for the content of third-party websites.

12. Events Outside Our Control

We will not be liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including but not limited to supply failures, industrial action, or disruption to transport or utilities.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland. Any disputes arising from them will be subject to the exclusive jurisdiction of the Irish courts.

14. Changes to These Terms

We may update these Terms from time to time. The version that applies to your Order is the version published on our website at the time you place it.
